These terms and conditions govern your use of the website operated by Langebaan Realtors (“we,” “our,” or “us”). By accessing or using our website, you agree to comply with these terms and conditions. If you do not agree with any part of these terms, you may not use our website.

Property listings displayed on our website are provided for informational purposes only and do not constitute an offer to sell or lease any property. We make no representations or warranties about the accuracy, completeness, or availability of property listings. You are solely responsible for verifying the accuracy of any information before relying on it.
4. User Submissions
By submitting any content or materials to our website, including but not limited to property listings, comments, or reviews, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide.
5. Limitation of Liability
In no event shall Langebaan Realtors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our website or the information contained therein. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.
6. Indemnification
You agree to indemnify, defend, and hold harmless Langebaan Realtors and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising out of or related to your violation of these terms and conditions or your use of our website.
7. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any dispute arising out of or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts located in the Saldanha Bay Municipality area.
8. Changes to Terms and Conditions
We reserve the right to modify or amend these terms and conditions at any time without notice. Any changes will be effective immediately upon posting on this website. Your continued use of our website after any changes constitutes acceptance of the revised terms.
Guaranteed Home Sale Program Terms and Conditions
1.Program Overview
The Guaranteed Home Sale Program ensures that Team Zulika guarantees to sell your property within 90 days or we will continue to market your home for an additional 30 days and not charge you any commission on the listing portion.
2.Eligibility Criteria
This guarantee is applicable only to properties with a market value of up to R3,500,000.
The listed price of the property must be set at a mutually agreed market value based on current market conditions and comparable homes.
3.Determination of Market Value
The market value will be determined through a comprehensive analysis of comparable homes and prevailing market conditions.
The final listed price must be agreed upon by both the property owner and Team Zulika before the property is listed for sale.
4.Signed Agreement Requirement
To qualify for the Guaranteed Home Sale Program, the property owner must enter into a signed agreement with Team Zulika. The signed agreement will explicitly state that if the property qualifies for the guarantee under the specified terms and conditions.
5.Commission Waiver and Additional Marketing Period
If the Seller’s home is not sold within the first 90 days of listing at the mutually agreed price, Team Zulika will continue to market the Seller’s home for an additional 30 days. During this additional 30-day period, Team Zulika will not charge the Seller any commission with respect to the listing portion of the commission. However, the Seller will be responsible for the selling portion of the commission if a buyer is brought by another agent from another agency/company.
6.Exclusions and Limitations
The guarantee is void if the property owner fails to comply with any terms of the signed agreement.
The guarantee does not apply to properties that are withdrawn from the market by the owner or for any other reason outside of Team Zulika’s control.
7.Free Sale Terms
If the property is not sold within the extended 120-day period (90 days plus the additional 30 days), Team Zulika’s commission fee for the listing portion will be waived. This waiver applies only to the listing portion of the commission. Other closing costs and fees associated with the sale of the property, as well as the selling portion of the commission, remain the responsibility of the property owner if a buyer is brought by another agent.
8.Amendments and Termination
Team Zulika reserves the right to amend these terms and conditions at any time. Any changes will be communicated to clients with active agreements. The program may be terminated or suspended at Team Zulika’s discretion, but such changes will not affect any properties currently under a signed agreement qualifying for the guarantee.
