Guaranteed Home Sale Program Terms and Conditions
1. Program Overview: The Guaranteed Home Sale Program by Langebaan Realtors gives homeowners peace of mind: If we don’t sell your home within 90 days at a mutually agreed market price, we will continue marketing it for an additional 30 days, and you will not pay us any commission. We will waive our portion of the commission in full.
2. Eligibility Criteria: This program applies to homes with a market value of up to R4,000,000. If your property is above this value, please contact us. We may approve higher-value homes on a case-by-case basis under a premium version of the program.
3. Determining Market Value: The market value is determined through a Comparative Market Analysis (CMA), based on comparable sales and current market conditions. The listing price must be agreed upon in writing by both the seller and Langebaan Realtors before marketing begins.
4. Signed Agreement Required To activate this guarantee, the seller must enter into a formal mandate with Langebaan Realtors, which includes all terms of this program. This agreement must remain valid and uninterrupted for the full 90-day period.
5. Commission Waiver & Additional Marketing Period
If Langebaan Realtors does not sell your home within the first 90 days:
• We will keep marketing your home for an additional 30 days.
• If your home sells after day 90, you will not pay Langebaan Realtors any commission. Our service is completely free after 90 days.
What if another agency brings the buyer? We sell the vast majority of our listings ourselves. However, in the interest of full transparency:
• If another agency introduces the buyer and the home is sold through them, you will still pay that agency their share of the commission.
• Langebaan Realtors will waive our portion of the commission completely — our 50% share (typically 2.5%) becomes zero.
Example: If the total commission is 5%, it’s typically split 50/50: 2.5% to Langebaan Realtors (listing agent), and 2.5% to the buyer’s agent (the other agency). In this case, you only pay the 2.5% to the other agency. Langebaan Realtors receives nothing — our 2.5% is completely free.
6. When the Guarantee Doesn’t Apply The guarantee becomes void if:
• The seller withdraws the property from the market.
• The seller fails to comply with the signed agreement (e.g., not allowing viewings or making major changes).
• The sale is delayed by legal or personal issues beyond our control.
7. What Costs Still Apply Even when Langebaan Realtors waives our commission, the seller is still responsible for:
• Standard transfer and legal fees (e.g., attorneys, transfer, bond-related costs).
• The buyer’s agent’s commission if the buyer is brought by another agency.
8. Program Changes Langebaan Realtors reserves the right to change or discontinue this program at any time. However, any updates will not affect active mandates already under agreement. Any changes will be communicated in writing.
